Thus, the project with new rules is a creation of the Ministry of Labor and Employment and is undergoing a period of study at the Civil House and the Planalto Palace. If the president gives his approval, the text will go to Congress.

What is the purpose of the benefit?
According to what Minister Luiz Marinho (Labor) told Folha, the idea is to correct an injustice. This is because for Marinho these people were “deceived” and after their dismissal they were unable to access their balance.
In this way, the minister aims to focus on workers who took out the anniversary loan to make this correction. According to him, the workers did not know that in the event of dismissal it would not be possible to withdraw the amount for approximately two years.

How does the anniversary withdrawal work?
It is important to highlight that this withdrawal model allows the worker to withdraw from 5% to 50% of the balance, with the right to an additional amount. Thus, annually there is a specific calendar with the installment release dates, following the workers' birthdays.
However, those who opt for this option lose the right to withdraw the balance upon termination, thus taking only the 40% of the fine. In other words, the worker can only have the right to the amount (in cases of dismissal without just cause) after 25 months.
Digital FGTS
The Minister of Labor also highlighted the creation of the digital FGTS, which should reduce the workload of companies collecting the amounts by up to 34 hours per month. Thus, with this new feature, deposits can be made via Pix and there will be more transparency in the process.
