The recent release of court-ordered payments by the Brazilian Judiciary marks a significant moment for INSS retirees and pensioners. Court-ordered payments, which are court orders for the payment of amounts owed by the government following court decisions, have begun to be released by the Federal Regional Courts (TRFs).

What are court orders?
Precatórios are court orders that arise when a person wins a lawsuit against the government. They are crucial to ensuring that citizens receive what they need in cases of legal action.
Thus, the current release follows a decision by the Federal Supreme Court (STF) that, in December 2023, ruled the Proposed Constitutional Amendment known as the 'PEC dos Precatórios' unconstitutional. This decision ensures the resumption of regular payment of federal precatórios, interrupted during the administration of former president Jair Bolsonaro.

INSS withdrawal schedule and process
It is important to note that withdrawals follow a schedule stipulated by each court. Therefore, as of January, the amounts are available in judicial accounts at Caixa Econômica Federal or Banco do Brasil.
For example, in the Federal Court of the 3rd Region, covering São Paulo and Mato Grosso do Sul, the deposit was approximately R$17 billion for 84,874 beneficiaries. In the TRF2, which includes Rio de Janeiro and Espírito Santo, the amount was R$18 billion for 22,534 beneficiaries.
Beware of INSS scams
Courts warn about the increase in scams related to court-ordered payments. It is important to note that there are no fees, deposits, or advances to receive these amounts. In addition, WhatsApp messages requesting the beneficiaries' phone number are not standard procedures, so be careful.
