FGTS anniversary withdrawal may change soon; understand

The FGTS anniversary withdrawal may undergo changes very soon. For those who are not familiar, this is a modality that allows withdrawal on the citizen's birthday. 

This option was introduced in 2019 and has been very popular among Brazilians ever since. However, there are those who are against this option, which could lead to some changes happening soon.

What will change in the FGTS anniversary withdrawal? 

The initiative by the Ministry of Labor seeks to offer workers the opportunity to withdraw their anniversary pay without being restricted by the termination fine. This measure, which involves a financial impact of R$14 billion, is awaiting analysis by President Lula.

It is important to highlight that this innovation aims to specifically benefit workers who chose the anniversary withdrawal in 2020. Thus, at that time, it was possible to obtain a loan using the FGTS, anticipating future amounts.

According to Luiz Marinho, Minister of Labor, this situation ended up “deceiving” workers, who, upon dismissal, lost full access to funds, making it impossible to withdraw the amount from the Guarantee Fund for 25 months.

The proposal in question aims to correct this gap and ensure retroactive benefits, as long as workers were laid off after 2020.

Modalities

The FGTS has two modalities, the termination withdrawal, which gives the worker the right to withdraw the total amount from the account, including the termination fine, in cases of dismissal without just cause. 

The other option is the anniversary withdrawal, which was introduced in 2019 and allows the worker to withdraw an annual portion of the balance in the FGTS account in the month of their birthday. Thus, the amount can vary between 5% and 50% of the sum of all the balances in the worker's FGTS accounts, with an additional amount related to the balance.
