Can an intern receive the thirteenth salary?
According to current legislation in Brazil, in particular the Internship Law (Law No. 11,788/2008), interns are not entitled to the thirteenth salary. This is because the internship is a learning contract and not a typical employment relationship.
Thus, the internship aims to provide students with the practical application of the theoretical knowledge acquired during their academic training. Therefore, it does not constitute a conventional employment relationship, which excludes the right to a thirteenth salary, paid vacations and other employment benefits.
It is important to note that the intern must receive a grant, in addition to being entitled to a thirty-day paid vacation for every twelve months of internship at the same company or institution.
However, it is worth noting that legal understanding may vary. Therefore, it is always advisable to consult a labor lawyer for specific guidance on each intern's situation.
Calculation
Payments of the first installment of the thirteenth salary have already been made, but people already want to know when the next payment will be. Therefore, the second installment of the benefit should be deposited in Brazilians' accounts on the 20th.
It is important to note that the calculation is based on dividing the total remuneration by 12. The result is then multiplied by the number of months worked. In addition, overtime, commissions and night shifts are also part of this calculation.
The basis for calculating the 13th salary is the gross payment amount, without deductions or advances.
Workers who are dismissed for just cause do not have the right to receive the amount and only those who have worked for at least 15 days can receive the money.
As mentioned before, the 13th salary is for workers with formal employment contracts, retirees and INSS pensioners can also receive it.
