The Federal Government launched the Desenrola Brasil program on June 6 of this year, focusing on renegotiating the debts of individual defaulters. Normative Ordinances MF No. 634/23 and No. 733/23 established the program.
Currently, Desenrola Brasil only renegotiates debts in Category 2, that is, those of individuals with monthly income of up to R$ 20,000 and debts incurred between January 1, 2019, and December 31, 2022.
Thus, defaulters can negotiate directly with banks such as Banco do Brasil, Bradesco, Caixa Econômica Federal, Nubank, and Banco Inter. In addition, the minimum repayment period for these debts will be 12 months.
However, for Category 1, those earning up to two minimum wages or registered with CadÚnico, the renegotiation will cover only debts of up to R$ 5,000. The Desenrola Brasil will begin renegotiations with this group in September.
Additionally, the Category 1 group may use loan funds guaranteed by the federal government's Fundo de Garantia de Operações (FGO) to pay the debts.

According to the Ministry of Finance, the Desenrola Brasil will hold a reverse auction among creditors, divided by credit category. Thus, the largest discount will be awarded in the program, ensuring that the debt is settled.
In addition, the Federal Government reveals that the program Desenrola Brasil will take place in three phases. Therefore, the first two phases have been active since July 17, covering bank debts up to R$ 100. During the auction, banks may use resources to ensure the negotiation of debts.

Although the Desenrola Brasil be beneficial, certain debts are excluded from the program. Therefore, debts that do not qualify include:
- Rural credit debts;
- Debts guaranteed by the Union or a public entity;
- Debts involving public funds;
- Debts without credit risk assumed entirely by the banks;
- Debts with interest equalization by the Union.
Finally, these exclusions apply to Tier 2, which is currently active.
Therefore, the federal government clarifies that in Tier 1, debts with collateral, rural credit, mortgage financing, and third-party risks will not be included.
However, with regard to Tier 2 debts of the Desenrola Brasil, currently in effect, only debts reported as delinquent up to December 31, 2022 qualify. Therefore, overdue debts from this year do not qualify for renegotiation through the program.
