The Federal Government enacted a provisional measure, guaranteeing emergency assistance of R$ 200 million intended for numerous Brazilians. Thus, beneficiaries who suffered material losses in Rio Grande do Sul will benefit.

Thus, Provisional Measure (MPV) 1,189/2023 was published in the extra edition of the Official Gazette of the Union (DOU) last Wednesday (27). Beneficiaries residing in municipalities with a state of calamity decree, due to the intense storms in the state, are the targets of this assistance. Find out more below.

Federal Government confirms Emergency Assistance for beneficiaries in Rio Grande do Sul
Financial assistance of up to R$ 200 million for this group has been in effect since the publication of MP 1,189/2023 in the DOU. In this way, two guarantee funds that provide services to companies secure this assistance.
Consequently, these funds are intended to increase the guarantees that banks require when granting loans to beneficiaries. In addition, this MP adds to another one, MP 1,190/2023, which made a benefit of R$ 400 million available to beneficiaries and those involved in family farming in Rio Grande do Sul.
These two initiatives are part of the Palácio do Planalto’s set of aid measures aimed at assisting municipalities in Rio Grande do Sul affected by the heavy rains and the resulting damage.

Does the measure have the potential to become law?
A provisional measure takes effect immediately but requires approval by the chambers of the National Congress, namely the Chamber of Deputies and the Federal Senate, to become law. The period for such deliberations is 4 months.
However, these chambers have already deliberated on significant proposals concerning the state of Rio Grande do Sul. For example, on September 12, the Senate ratified decree PDL 321/2023, validating the state of emergency in 98 municipalities in RS until December 31, 2024.
Additionally, the Chamber of Deputies ratified a decree granting Rio Grande do Sul and such municipalities an exemption from the limitations of the Fiscal Responsibility Law (LRF), following the validation of a state of calamity.
