Procon in this region, associated with the Secretariat of Justice and Citizenship (Sejus), fined a bank more than R$ 800 thousand for improperly authorizing credit for elderly people and retirees. The penalty is based on district law No. 6,930/21, which prevents banks from offering payroll-deducted loans to elderly people through telephone calls.

The incident occurred in the Federal District and focused on the bank Agibank, after the consumer protection agency registered 3 complaints. In all of them, the complainants mentioned the completion of loan renegotiation agreements or credit card requests without proper authorization.

Upon receiving the complaints, the agency promptly contacted Agibank and warned it about the inappropriate action. In response, the bank sent copies of the transactions and agreements carried out by the customers.

However, the records showed that the procedure adopted to enter into such contracts was “by telephone” – an evident violation of the Federal District’s legislation. According to Procon’s director general, Marcelo Nascimento, “the bank commits at least two errors: by offering credit without proper authorization and by doing so to elderly people or retirees via telephone or WhatsApp,” he stated.

After receiving the documents from Agibank, Procon imposed a fine of R$ 806,780.00 on the bank, corresponding to the 3 complaints from elderly people. The amounts reflect the penalty for violating the Consumer Protection Code and the aforementioned district law.

In conclusion, it is important to note that Agibank has not yet issued an official position on the case. It is also worth mentioning that the Credit Offering Law is specific to the Federal District, in effect since August 2021. However, the penalty for failing to comply with this rule is R$ 200,000. In the event of repeat offenses, Procon may request the revocation of the company’s state registration.
