Since September 2022, the establishment of the new National Nursing Wage Floor has faced a pause due to a ruling by Justice Luís Roberto Barroso of the Federal Supreme Court (STF). Barroso requested that public and private healthcare entities demonstrate the economic repercussions of the action. According to the states, implementation requires R$ 10.5 billion from local treasuries, and there are no funds available for this.

In May, President Luiz Inácio Lula da Silva (PT) approved the allocation of R$ 7.3 billion for the distribution of the wage floor. Thus, Barroso authorized the implementation of the National Nursing Wage Floor.

Additionally, Barroso instructed the states, the Federal District, and the municipalities, as well as private entities that serve at least 60% of their patients through SUS, to adopt the new wage floor with the financial support provided by the Union.
