In this way, Bohn concluded that the bank failed to provide the service it should have guaranteed to the affected customer. As a result, the Caixa account holder lost R$ 30,000 after becoming the victim of fraud.

The scheme in question involved a fake support center. This deceptive method persuades individuals to think that they are interacting directly with the financial institution.

The fraudsters make contact by phone, email, or message, offering assistance or conveying incorrect information. The primary goal is to extract personal or financial information, or even resources, from the targets, thereby compromising their integrity and privacy.

What stands out in this episode is that the Caixa customer recognized the scam. When asked to provide confidential data such as her card PIN, she ended the call. However, the financial damage had already occurred.

According to the testimony, even without providing her bank password, the customer witnessed a R$ 30,000 transaction via Pix. This action occurred without her consent, which led the customer to accuse the bank of negligence for allowing the scammers to access her funds.

There was a failure in the service provided by the institution or a lack of clear guidance on the use and risks of the account. Therefore, in addition to the security lapse, Caixa must pay R$ 10,000 in compensation for moral damages. Thus, the amount to be awarded to the affected customer will total R$ 40,000.
