Court orders Caixa to make additional payments to several employees

The decision was issued by the 3rd Panel of the Regional Labor Court of the 10th Region of São Paulo. The National Confederation of Workers in the Financial Sector (Contraf-CUT) filed the lawsuit after the bank annulled the regulation.

The judges also determined that not only employees who have held the same position for more than a decade will be entitled to the bonus. They thus concluded that all employees hired by November 9, 2017, must receive the allowance, confirming the lower court’s ruling.

Therefore, the contracts of these workers affiliated with unions associated with Contraf-CUT will incorporate the regulation. RH 151 established the payment of a bonus to reward those who held a position or a position of trust at Caixa for a decade or more.

According to Juvandia Moreira, leader of Contraf-CUT, this decision represents a victory for workers, since this bonus constitutes a significant portion of many of their earnings. “Some leaders began using the retention of the bonus as a means of pressuring employees to achieve targets,” she added.

In turn, Luiza Hansen, a Union director and Caixa employee, stressed that the entities have always opposed the annulment of the regulation, as this violates employees' rights. She also emphasized that, even though Caixa may appeal the decision, it represents a significant legal victory in favor of these workers.
