The imprisonment allowance is a benefit created in 1960, paid monthly by the INSS. It covers people who depend on individuals serving a sentence in a closed regime within the prison system. It is a way to provide financial support to the inmate's family members.
In cases where they are the head of the family, the benefit becomes indispensable. The amount is paid only to those who have a direct relationship with the detainee. Thus, they will not receive any type of assistance, as they have no means of generating income.

Who can receive the imprisonment allowance

The benefit covers dependents of incarcerated people who can prove their low-income status. Beneficiaries must prove their relationship with the detainee and how they depend on the individual financially. Therefore, dependents were divided into three categories.
Class 1:It covers spouses and partners in a common-law marriage. Children are also included in this category. They must be up to 21 years old and not emancipated. In addition, the benefit covers children with some type of disability. These individuals receive the benefit due to their family relationship with the inmate.
Class 2:This category includes the detained person's parents. Therefore, economic dependence on the person deprived of liberty must be proven.
Class 3:This category covers the inmate's siblings who are under 21 years old. Members of this group must also prove that they are financially dependent on the detainee.

The incarceration benefit corresponds to the minimum wage in effect in the country. Thus, beneficiaries are eligible to receive R$ 1.320, according to the minimum wage established on May 1, 2023.
However, the inmate's maximum gross income must be R$ 1.754,18. If the amount exceeds this value, dependents are not entitled to receive the benefit. They also cannot receive other types of benefits, such as pensions and retirement benefits.
