The Federal Justice Council (CJF) has released R$ 2 billion for INSS retirees and pensioners. Find out who will have access to this amount.
The CJF made R$ 2 billion available to settle outstanding payments from the National Social Security Institute (INSS). The Federal Courts in each region will allocate these funds and take responsibility for establishing the accounts and making the payments to retirees and pensioners.
On October 20, the CJF authorized more than R$ 2.3 billion to settle Small-Value Claims (RPV) related to the federal government. Of this total, approximately R$ 2 billion is intended to pay cases involving the INSS.

Small-Value Claims refer to cases whose value does not exceed 60 minimum wages (R$ 79.2 thousand) for those who won the lawsuit. Therefore, more than 122,000 INSS beneficiaries will have their amounts credited.
Who is entitled to the R$ 2 billion from the INSS?
According to the CJF, the amount of R$ 2 billion is intended for those who filed lawsuits against the INSS and were successful, with no possibility of further appeals by either party. Therefore, in September 2023, 95,504 cases met these criteria.
Thus, to access the amount, policyholders must meet the following conditions:
- Win their lawsuit against the INSS, with no option for further appeal;
- The compensation awarded in the case cannot exceed R$ 79,200;
- The judge's authorization for payment must be issued on any date in September 2023.

When will the beneficiaries receive the payment?
The amount of R$ 2 billion, intended for policyholders who prevailed over the INSS in court, will not be transferred directly to retirees' and pensioners' accounts. The Federal Court corresponding to the beneficiaries' state of residence will be responsible for receiving the amount and arranging its transfer to an account in the beneficiary's or their attorney's name.
Consequently, to obtain information about the availability of the amount, it will be essential to consult each Federal Court's system and monitor the completion of the payment.
