Compensation for moral damages granted to the customer
Moral damages involve harm to an individual's dignity, honor, privacy, reputation, and emotional or psychological stability. Unlike material damages, which consist of tangible financial losses, moral damages are challenging to calculate in monetary terms.
The amount of such compensation varies according to the severity of the incident. Judges consider various factors when setting the amount, such as the degree of suffering, for example.
In this specific case, Judge Paula Carine Matos de Souza emphasized that the client's daughters remained outside the branch while their father was trapped inside, and the incident occurred at night, increasing the risks and dangers.
Payment deadline established
Judge Souza set the compensation at R$ 4,000, taking into account the principles of proportionality and reasonableness, as well as the harm caused to the client. This assessment aims to ensure fair and adequate financial compensation.
The decision also stipulates a deadline for Banco do Brasil to pay the compensation: 15 days. If the bank fails to meet this deadline, it will have to pay a statutory fine of 10% of the amount owed.
