Those who resort to the courts to obtain or review benefits from the National Institute of Social Security (INSS) have the right to receive arrears, which are past sums owed.

Therefore, these sums represent discrepancies not settled in the five years prior to the legal process. Thus, when the amounts reach up to 60 minimum wages (R$ 79,200.00), they refer to a Small Value Request (RPV), which is released monthly. Explore more information!

INSS outstanding disbursement schedule

The central government pays off outstanding INSS debts, since it is a federal debt, dividing the sums between the Federal Regional Courts (TRFs) and the Federal Justice Council (CJF). Therefore, see the schedule for disbursing outstanding amounts for this year:

Check the RPV on the TRF portal for the area where you started the process. Examine and select the link:

  • TRF 1st Region: headquarters in the Federal District, with jurisdiction in the Federal District, Minas Gerais, Goiás, Tocantins, Mato Grosso, Bahia, Piauí, Maranhão, Pará, Amazonas, Acre, Roraima, Rondônia and Amapá;
  • TRF of the 2nd Region: headquarters in Rio de Janeiro, with jurisdiction in Rio de Janeiro and Espírito Santo;
  • TRF of the 3rd Region: headquarters in São Paulo, with jurisdiction in São Paulo and Mato Grosso do Sul;
  • TRF of the 4th Region: headquarters in Rio Grande do Sul, with jurisdiction in Rio Grande do Sul, Paraná and Santa Catarina;
  • TRF of the 5th Region: headquarters in Pernambuco, with jurisdiction in Pernambuco, Ceará, Alagoas, Sergipe, Rio Grande do Norte and Paraíba.

Making the payment

The payment procedure unfolds as follows:

  1. The government transfers the amount to the CJF (Federal Justice Council) as requested by the court;
  2. The CJF allocates the funds to the TRF (Federal Regional Court) in charge of the case in the area where the citizen sued the INSS;
  3. The beneficiary must check whether they will receive the sums on the TRF portal in their region;
  4. The citizen can also contact the responsible lawyer to find out the status of the disbursement;
  5. Immediately after the funds are made available, the processing phase begins, which includes creating accounts at Caixa Econômica and Banco do Brasil. This step usually ends quickly;

After finishing processing, the system updates the information, and the citizen can view it by accessing the TRF portal or through their lawyer.
