On October 18, the Supreme Federal Court (STF) will resume the trial concerning the correction of the Severance Pay Guarantee Fund (FGTS), which has been on hold since April of this year. Therefore, the discussion will focus on a Direct Action of Unconstitutionality (ADI 5090), which challenges the current practice of correcting the fund's balance.

In short, the current regulations establish that FGTS account balances are updated based on the Reference Rate (TR), plus annual interest of 3%. However, this index has proven ineffective against inflation. Learn more!

FGTS Correction

Since 1999, the TR has ceased to reflect the purchasing power of the currency and thus the reduced rate has inflicted losses on workers. Considering that the TR, as of 2017, is approaching zero, annual income stagnates at 3%.

Given this scenario, according to analyses by LOIT, a company focused on reviewing the FGTS, the estimate is that each worker will receive around R$10,000. However, this amount may exceed 60 minimum wages (R$79,200.00), fluctuating according to the balance in the fund and the worker's average income.

Beneficiaries of the correction

However, it is crucial to emphasize that the FGTS correction will not include all workers. This review is linked to the financial update of the balance in accounts linked to the fund. Therefore, workers who have maintained a long-term employment relationship will benefit more from the correction.

Finally, according to LOIT FGTS, a worker who contributed for 10 years after 1999 and whose salary was around the minimum wage, may receive approximately R$1,400,000 with the FGTS adjustment. On the other hand, for those who changed jobs regularly, the review may not be as beneficial.
