A verdict by the Federal Supreme Court this week is expected to impact many Brazilian workers. By a vote of 8 to 3, the supreme court ordered the elimination of parts of the Truck Drivers' Law addressing drivers' working hours, rest periods, and the division of breaks.

STF Amends Sections of the Truck Drivers' Law
The changes to Law 13.103/2015, known as the Truck Drivers' Law, stipulated that drivers must take 35 hours of weekly rest every 6 days of work. Another modification was the removal of meal, rest, and break periods from the total working hours.
Furthermore, truck drivers will no longer be allowed to rest while the vehicle is in motion. Even if another driver takes over, the truck must be stopped to fulfill the rest period. The rest period must be 11 hours within 24 hours of work, and splitting this time is prohibited.
Concern about cargo safety
The changes to the law implemented by the STF have raised concerns regarding transported goods. This is because truck drivers may have to stop in unsafe areas, increasing the likelihood of robberies. As a result, cargo insurance costs may increase.
In light of this, the alternative for transport companies is to invest in escorts to prevent the loss of goods during rest periods, especially at night. The duration of the trip will also increase, which may raise the cost of insurance and freight.
Finally, it is important to mention that, according to data released by the National Association of Cargo Transportation and Logistics (NTC&Logística), 13,089 cargo robberies were recorded in Brazil in 2022, an average of 35 per day.
