INSS retirees will receive R$2 billion after court ruling

The Federal Justice Council (CJF) released R$2 billion for INSS retirees and pensioners. Find out who will have access to this amount.

The CJF has made R$2 billion available to settle arrears owed by the National Institute of Social Security (INSS). The Federal Courts of each region will allocate this money and assume responsibility for establishing the accounts and making payments to retirees and pensioners.

On October 20, the CJF authorized more than R$2.3 billion to settle Small Value Requests (RPV) related to the federal government. Of this total, approximately R$2 billion are intended for the payment of processes related to the INSS.

Small Value Requests refer to processes whose value does not exceed 60 minimum wages (R$ 79.2 thousand) for those who won the action. Therefore, more than 122 thousand INSS beneficiaries will have their amounts credited.

Who is entitled to R$2 billion from INSS?

According to the CJF, the amount of R$1.4 billion is intended for those who filed lawsuits against the INSS and were successful, with no room for additional appeals by either party. Therefore, in September 2023, 95,504 lawsuits met these criteria.

Therefore, to have access to the amount, policyholders must meet the following conditions:

  • Obtain victory in your action against the INSS, without the option of additional appeal;
  • The compensation for the lawsuit cannot exceed R$79.2 thousand;
  • Payment authorization by the magistrate must occur on any date in September 2023.

When will beneficiaries receive it?

The amount of R$1.4 billion, intended for insured individuals who triumphed over the INSS in court, will not be transferred directly to the accounts of retirees and pensioners. The Federal Court, corresponding to the state of residence of the beneficiaries, will be responsible for receiving the amount and arranging for its transfer to an account in the name of the beneficiary or his/her lawyer.

Consequently, to obtain information on the availability of the amount, it will be essential to consult the system of each Federal Court and monitor the effective payment.
