What will change in the FGTS?

If you have opted for the FGTS anniversary withdrawal option, be careful, a lot can change! This is because the Ministry of Labor has sent a new project to the Civil House so that workers who have chosen this option can withdraw the remaining amount from their account.

About the proposal that could change the FGTS

It is important to highlight that the Ministry of Labor's proposal will allow workers who opted for birthday withdrawal withdraw the full amount from their accounts. In other words, there will be no limitation on the termination fine. 

The current birthday withdrawal model works as follows:

  • Workers withdraw the amount annually in the month of their birthday;
  • In cases of dismissal, it is only possible to recover the termination fine. 

Therefore, if the proposal is approved, the change could cost up to R$14 billion. The project still needs to be analyzed by Lula before going to the National Congress. 

What are the types of FGTS? 

Currently, the FGTS has two modalities: termination withdrawal and birthday withdrawal. In the first case, workers can withdraw the total amount from the account, including the termination fine in situations of unfair dismissal. 

The anniversary withdrawal, which was introduced in 2019, allows the employee to withdraw annually in the month of their birthday. However, in the event of dismissal, the employee only has access to the severance pay and not the total balance. Therefore, this option can be somewhat detrimental in some aspects. 

Will the anniversary withdrawal end? 

Luiz Marinho, the Minister of Labor, wants to end the birthday withdrawal, since he considers the model harmful to workers. However, Congress is showing some resistance to ending the model. 

In other words, there is still no final answer regarding the modality, but Marinho expressed the intention of at least reviewing the modality.
